Prince Edward Island therapy clinic regulations for private pediatric clinics

Prince Edward Island therapy clinic regulations rest on the Health Information Act, which lists a physiotherapy clinic as a health care facility and makes its operator a custodian, and on the Regulated Health Professions Act, which governs the speech-language pathology, occupational therapy and physiotherapy colleges. Several provincial government pages blocked automated access, college standards were not located, and the child-protection Act could not be read, so some sections below say “not found on the official pages we read”. Every rule that is stated links to the official page we read on 2026-10-08.

Health privacy: the Health Information Act

The Health Information Act defines a custodian as a person or organization that collects, maintains, uses or discloses personal health information to provide or assist in providing health care, and it names a health care provider “when not acting as an agent of a custodian” and the operator of a health care facility [PEI-1]. A health care provider is a person registered or licensed to provide health care under an enactment, or a member of a class designated in the regulations. An agent may include an employee, volunteer, contractor or information manager. A privately owned multidisciplinary clinic is plausibly a custodian itself, with employees and contractors as agents, and an independent registered contractor who is not the clinic’s agent could be a separate custodian; the Act does not resolve this, so ask the Commissioner or counsel. Unregulated behaviour technicians are not health care providers unless the regulations designate them, and we did not check the regulations.

A custodian that retains an agent for collection, use, disclosure, retention or secure destruction of information must have a written agreement with that agent (s. 41), and a written agreement is also required with an information manager that processes, stores or destroys information or provides IT services (s. 42). Consent may be express or implied. A custodian may assume implied consent to collect or use information, or to disclose it to another custodian to provide care, but disclosure to a non-custodian needs express consent (s. 13).

On a breach, the custodian notifies the individual and the Commissioner in writing at the first reasonable opportunity (s. 36(1)(c)). The Commissioner’s April 2024 guidelines add that the notice to the individual should say the person may ask the Commissioner for a review, and that after containment, investigation and remediation the custodian prepares a written Breach Investigation Report [PEI-3]. The guidelines say the Commissioner’s form is on the office’s website at www.oipc.pe.ca, and the Commissioner’s Legislative Assembly page is linked below [PEI-4].

The Act has no retention period; it defers to other enactments (s. 39(5)). A custodian adopts safeguards that address risks such as the location of storage, provides for secure storage, retention and disposal, and ensures agents follow the same controls (s. 39). Designating a compliance contact is optional (s. 37). An access request is answered within 30 days, and silence after that is treated as a refusal (s. 8). A person may examine a record without charge, the custodian gives an estimate before charging any permitted fee, and the individual can ask for a waiver (s. 80). Several access sections carry 2025 amendment tags; we did not determine their in-force dates. An offence is punishable by a fine up to $15,000 or six months for an individual and $50,000 for a corporation (s. 79).

The Office of the Privacy Commissioner of Canada’s list of substantially similar provincial health laws names four other provinces and does not name Prince Edward Island [PEI-5]. How the Health Information Act sits with PIPEDA for a fee-for-service clinic is not addressed in the sources we read, so put that question to counsel.

Professional regulators: three colleges and some open questions

The Regulated Health Professions Act lets the Lieutenant Governor in Council designate a profession and its college by regulation, and once a profession is designated no one may practise it except as a member, unless the profession is prescribed as title protection only (s. 2) [PEI-6]. Members must not advertise in a way that is untruthful, inaccurate or capable of misleading or misinforming the public (s. 92). A member who has knowledge or reasonable grounds to believe that another member committed professional misconduct, or committed sexual abuse involving a client, must report to the other member’s registrar (s. 62). The table lists what the three therapy regulations and the Act say; the cells that say “not found” record the limits of our reading.

The Reserved Activities Regulations are listed on the physiotherapy college’s page and in the sources directory below. The Act lets regulations prescribe the records and accounts members keep, and we found none in the three therapy regulations.

Working with children: consent, reporting and police checks

The Consent to Treatment and Health Care Directives Act presumes every person capable of giving or refusing consent to treatment until the contrary is demonstrated (s. 3). For a patient found incapable, the practitioner looks to a decision-maker in a listed order that includes the parent, and the decision-maker must be at least sixteen unless a parent under sixteen is deciding for their child (s. 11) [PEI-2]. The Act does not set an age at which a child can consent alone. The Health Information Act lets a parent or guardian exercise a minor’s rights where, in the custodian’s opinion, doing so would not be an unreasonable invasion of the minor’s privacy (s. 76(1)(c)). Rules for separated parents were not found on the official pages we read.

The Child, Youth and Family Services Act PDF on the provincial legislation site [PEI-9] returned no readable text to our tools, and the provincial information pages we requested returned a bot-verification page. The duty to report suspected abuse, its age threshold, its penalties and a reporting number are therefore not found on the official pages we read. Check the Act directly and with the Department before writing a reporting policy.

No statute or college rule requiring police checks of therapy staff was found. The preschool autism funding guideline says a current criminal record check and vulnerable sector check “is recommended” for Autism Assistants, who must be at least 18 and not members of the child’s immediate family [PEI-8]. A Prince Edward Island police page for obtaining these checks was not found on the official pages we read.

Running the clinic as a business and employer

A corporation applies to the registrar for a permit to operate as a health profession corporation (RHPA s. 15). Voting shares must be owned by a member, a trust whose trustees and beneficiaries are all members, another health profession corporation, or a corporation wholly owned by those. All officers and directors must be members, the people who practise on the corporation’s behalf must be registered members, and the corporation must hold the liability insurance the regulations require [PEI-6].

Section 90(1) adds that, except where the regulations provide otherwise, no corporation other than a health profession corporation may carry on the business of providing a member’s professional services. The physiotherapy regulations contain an exception (s. 20.1). We found no equivalent in the occupational therapy or speech-language pathology regulations we read [PEI-10]. How section 90(1) applies to a corporation owned by someone who is not a member, employing registrants from those professions, is not stated in the sources we read, so put the question to the colleges or counsel. A licence or registration for the owner of a clinic who is not a registrant was not found on the official pages we read.

An employer in an industry covered by the Workers Compensation Act, with at least one regular or part-time worker, registers with the Workers Compensation Board. New employers register before the start of operations, and each year by 28 February the employer renews by reporting actual payroll for the previous year and estimated payroll for the current one. Late registration can bring an arbitrary assessment, penalties and reimbursement of claim costs from before registration. The page does not address owners, partners or contractors, and whether a therapy clinic falls within a covered industry was not confirmed, so ask the Board [PEI-11].

Under the Occupational Health and Safety Act, an employer with five or more workers regularly employed establishes and reviews at least annually a written occupational health and safety policy (s. 24), and one with twenty or more also has a written program (s. 23). Where five or more workers are employed and no joint committee is required, workers select a representative (s. 26) [PEI-12]. The Workplace Harassment Regulations, consolidated to 1 July 2020, require the employer to develop and implement a written harassment policy [PEI-13]; check later amendments.

Business registration, employment standards, first aid, premises licensing and a contractor-versus-employee test were not found on the official pages we read, because the provincial HTML pages we requested returned a bot-verification page. An accessibility Act with standards in force and a licence for private therapy clinics were not found either.

Funding programs and insurers

The preschool autism funding goes to the “Employer”, defined as a parent, legal guardian or licensed early learning and child care centre that hires an Autism Assistant to deliver intensive behavioural intervention for a child in the Early Years Autism Service. The employer signs a Funding Agreement with the Department. Children typically receive 20 hours a week, rising to 25. The Department funds wages at the wage grid for certified assistants or at minimum wage for uncertified ones, up to 25 hours a week, plus 12.59 per cent of the funded amount toward pension, employment insurance, workers’ compensation and vacation pay. Funded interventions must be evidence-based. The employer submits time-tracking logs signed by the employer and the assistant, direct deposit is required, and logs for the 2026-27 fiscal year are due by 16 April 2027. The guideline was updated in June 2026 and lists the Early Years Autism Funding office in Summerside at 1-833-335-0546 [PEI-8].

A private clinic is not a payee under that guideline: the Department pays the employer, and the employer pays the assistant. The guideline mentions team communication with professionals who are employed privately, which requires written parent consent. A school-age autism funding guideline, provider billing for Workers Compensation Board claims, automobile accident benefit billing and routes for private clinics into publicly funded therapy were not found on the official pages we read.
